Terms of Use

1. Your agreement with us

These Terms of Use ("Terms") are a contract between you and Star Billion Engineering Limited, which operates AsAce and publishes it on Google Play under the developer name THRIVING HK ("AsAce," "we," "us," or "our").

They govern the AsAce Android app and its account, profile, discovery, one-to-one messaging, voice, media, audio and video communication, digital purchase, advertising, support, moderation, and safety functions (the "Service"). The Privacy Policy and Child Safety Policy are part of these Terms.

2. Adults only

You may use AsAce only if you are 18 or older, can legally enter this agreement, and are not prohibited from using the Service under applicable law. You must not misstate your age, help a minor bypass an age control, permit a minor to use your account, or include a minor in an adult AsAce interaction.

We may use age gates, account history, eligibility signals, and proportionate verification measures. We may restrict access while a review is pending and may close an account that is ineligible or reasonably suspected of minor access. An age-control process reduces risk but cannot guarantee that every user gives accurate information.

3. Accounts and profiles

Registration and profile information must be accurate, current, and yours to provide. Keep control of the login method linked to your account, protect credentials, and notify us promptly if you suspect unauthorized access. Do not sell, rent, lend, share, or transfer an account.

A profile name, image, biography, interest, preference, and other representation must not impersonate a person, violate another person's rights, or materially deceive users. Automated, bulk, fraudulent, and repeat-abuse accounts are prohibited. You are responsible for activity through your account to the extent permitted by applicable law.

4. Communication through AsAce

AsAce enables adults to discover profiles and communicate through text, voice messages, selected media, and one-to-one audio or video sessions. You control whether to start, accept, continue, or end an interaction. Features, recommendations, connection quality, and availability may vary by country, device, app version, and account.

We do not promise a particular connection, response, audience, compatibility, identity verification, background check, or outcome. Use judgment and protect personal, location, account, and financial information. Report, block, or end an interaction when it feels unsafe.

5. Camera, microphone, privacy, and recording

Camera and microphone access is used after you grant Android permission and activate a feature that requires it. You may revoke permission in Android settings, but video, audio, voice-message, or capture features may stop working.

Obtain every consent required by law before recording, capturing, publishing, or redistributing another person's image, voice, message, or call. Covert recording, voyeurism, blackmail, sexual coercion, and non-consensual intimate material are prohibited. A recipient may preserve a communication using tools outside AsAce, so do not assume that a call or message will remain confidential.

6. Your content

You retain ownership of original profile material, messages, audio, images, video, reports, feedback, and other content you provide ("User Content"). You represent that you have the rights and permissions needed to provide it and that it complies with these Terms.

You grant Star Billion Engineering Limited a non-exclusive, worldwide, royalty-free, sublicensable license to host, cache, reproduce, format, transmit, display, and technically modify User Content only as reasonably necessary to operate, secure, moderate, maintain, and improve AsAce; follow your settings; enforce these Terms; and meet legal duties.

The license ends when content is removed from active systems, except when a copy remains with another user, in a controlled backup, in a safety or legal record, or where continued retention is otherwise allowed or required by law.

7. Prohibited use

You must not use AsAce to:

• violate law, valid legal orders, sanctions, or another person's privacy, publicity, intellectual-property, or contractual rights;
• harass, stalk, threaten, shame, coerce, extort, exploit, deceive, discriminate against, or endanger another person;
• create, request, possess, transmit, promote, or facilitate child sexual abuse material, grooming, sextortion, child trafficking, or any other child endangerment;
• share non-consensual intimate material, sexual violence, credible threats, or instructions for serious wrongdoing;
• impersonate a person or organization, misstate age or identity, or operate romance, investment, payment, account-recovery, or other scams;
• send spam, malware, unauthorized advertising, automated messages, scraping requests, or disruptive traffic;
• collect, disclose, or sell another user's information without authorization;
• reverse engineer, bypass access or safety controls, probe security, manipulate advertising or purchases, or interfere with the Service; or
• buy, sell, exchange, or transfer an account, digital item, credit, or access outside an authorized AsAce feature.

8. Reports, blocks, moderation, and appeals

Use the report or block control available from the relevant profile, conversation, or active or recent call. Reports must be truthful and made in good faith. Never download or email suspected child sexual abuse material; use the in-app report route and follow the Child Safety Policy.

We may use automated signals and trained review to assess reported or suspected violations. Depending on risk and context, we may end an interaction, remove or restrict content, limit features, issue a warning, reduce visibility, suspend or terminate an account, prevent repeat registration, preserve evidence, and contact an authority or qualified safety organization when appropriate or required.

Moderation cannot guarantee that every violation will be detected or prevented. Where appropriate and legally permitted, an adult user may appeal through available support. Safety, victim privacy, legal restrictions, and investigative integrity may limit what we can disclose.

9. Child safety

AsAce has zero tolerance for child sexual abuse and exploitation (CSAE) and child sexual abuse material (CSAM). Minors may not use the Service. The AsAce Child Safety Policy publishes our standards, reporting instructions, enforcement approach, cooperation process, and designated contact.

10. Digital purchases and Google Play Billing

AsAce may offer credits, digital items, virtual benefits, or paid feature access through Google Play Billing. The checkout screen presents the product, price, and material terms before payment. A purchase is not automatically recurring unless that screen expressly identifies it as a subscription.

Digital items are licensed rather than sold. They have no cash value, are not legal tender or stored value, and may not be transferred outside an authorized feature. We may correct a balance affected by an error, refund, chargeback, fraud, or unauthorized activity.

Google Play processes sensitive payment credentials and applies its billing and refund rules. Except where applicable law requires otherwise, a consumed digital item is non-refundable. Deleting AsAce or an AsAce account does not itself create a refund and may not cancel billing that Google Play manages separately.

11. Advertising and independent services

AsAce may display contextual or personalized advertising where permitted. The Privacy Policy explains related information and choices. An advertisement does not mean that we endorse the advertiser or offer.

The Service may rely on or link to independent providers, websites, SDKs, or platforms, including Google Play. Their own terms and privacy notices govern their products. To the extent permitted by applicable law, we are not responsible for an independent third party's content or conduct.

12. AsAce property and limited license

The AsAce software, interfaces, design, logos, trademarks, documentation, and content supplied by us or our licensors are protected by law. Subject to these Terms, we grant you a personal, limited, revocable, non-transferable, non-sublicensable license to use the Android app for its intended purpose.

You may not copy, sell, publicly distribute, build a derivative product from, or use AsAce branding without permission, except where applicable law expressly permits the activity and does not allow this restriction.

13. Changes, suspension, termination, and deletion

We may add, change, suspend, or retire features to address safety, security, law, technical limits, demand, or business needs. We will provide notice where required. Experimental features may be incomplete or unavailable on some devices or in some locations.

You may stop using AsAce at any time and can request permanent deletion through the app or the Account Deletion page. We may restrict or terminate access when reasonably necessary to enforce these Terms, address safety or fraud, comply with law, protect users, or discontinue the Service.

After termination, your license ends. Provisions that logically survive, including ownership, payment obligations, retained-content permissions, disclaimers, liability limits, indemnity, and dispute terms, remain effective.

14. Disclaimers

To the fullest extent permitted by applicable law, the Service is provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, quiet enjoyment, and warranties arising from a course of dealing. We do not guarantee uninterrupted or error-free operation, a particular connection or result, another user's identity or conduct, or the accuracy or safety of User Content.

Nothing in these Terms excludes a warranty, remedy, or consumer right that applicable law does not allow us to exclude.

15. Limitation of liability

To the maximum extent permitted by applicable law, Star Billion Engineering Limited and its affiliates, officers, employees, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential loss, including lost profits, data, goodwill, opportunity, or loss arising from another user's or independent third party's conduct.

These limits do not apply to liability that cannot lawfully be excluded or limited. Mandatory consumer protections remain available.

16. Indemnity

To the extent permitted by law, you will defend, indemnify, and hold harmless Star Billion Engineering Limited and its affiliates, officers, employees, and agents from third-party claims, losses, liabilities, and reasonable legal expenses arising from your unlawful use of AsAce, your User Content, or your material breach of these Terms. This does not apply to the extent a claim results from our unlawful conduct.

17. Disputes and applicable law

Before filing a claim, you and we will make a reasonable good-faith effort to resolve it informally through the contact below. These Terms are governed by the law applicable to Star Billion Engineering Limited and the transaction, without applying conflict-of-law principles to the extent permitted. A claim may be heard by a court with competent jurisdiction.

Nothing here removes a mandatory consumer protection or access to a local court that applicable law does not permit you to waive.

18. Updates and general provisions

We may update these Terms to reflect changes in AsAce, safety practices, operations, or law. Material changes will receive notice where required. If a provision is unenforceable, it will be modified to the minimum extent necessary or severed, and the rest will remain effective. Failure to enforce a provision is not a waiver.
